Pennsylvania landlord-tenant law, explained for tenants and landlords

Security deposits, habitability and repairs, notices to quit, eviction hearings, Orders for Possession, and appeals under the Landlord and Tenant Act of 1951.

ABOUT THIS BOOK

A rental dispute in Pennsylvania comes with strict notice periods and its own courts. Notice to quit? Order for Possession? Supersedeas?

The Pennsylvania Landlord-Tenant Guide explains the Landlord and Tenant Act of 1951 and the court rules that govern residential rentals. It covers lease basics, the security deposit limit of two months' rent in the first year and one month's rent after that, escrow and interest on deposits held more than two years, and the 30-day deadline for returning a deposit or itemizing deductions. It explains the court-made warranty of habitability, rent withholding into escrow, repair-and-deduct, landlord entry, retaliation, and abandoned property.

For evictions, the guide explains the 10-, 15-, and 30-day notices to quit, the Landlord and Tenant Complaint in Magisterial District Court or Philadelphia Municipal Court, the hearing, the 10-day appeal period, the Order for Possession, the tenant's right to pay and stay before the lockout in nonpayment cases, and appeals to the Court of Common Pleas.

QUESTIONS BEFORE YOU BUY

Pennsylvania landlord tenant law: what to know before you order.

Straight answers about what the guide is, what it covers and how it reaches you.

When must a landlord return a security deposit in Pennsylvania?

Within 30 days after the lease ends or the landlord accepts surrender of the premises, the landlord returns the deposit or provides a written, itemized list of deductions. A landlord who fails to comply may be liable for double the amount wrongfully withheld (68 P.S. § 250.512).

How much notice comes before an eviction for nonpayment in Pennsylvania?

For nonpayment of rent, the Landlord and Tenant Act calls for a 10-day written notice to quit (68 P.S. § 250.501(b)). Other notices run 15 or 30 days depending on the lease term, and a lease can change or waive the notice period. The guide explains each.

Is this legal advice?

No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.

Is it written for Pennsylvania?
