Pennsylvania divorce, custody, and support, explained step by step
Mutual consent and one-year separation divorce, equitable distribution, alimony, the best-interest custody factors, and child support guidelines, explained for both spouses.
ABOUT THIS BOOK
A marriage is ending in Pennsylvania, or a custody question has come up, and the terms are unfamiliar. Affidavit of consent? Praecipe to transmit record? Alimony pendente lite?
The Pennsylvania Family Law Guide explains how divorce and custody cases work in the county Courts of Common Pleas. It covers the six-month residency requirement, no-fault divorce by mutual consent with its 90-day waiting period, divorce after a one-year separation when one spouse will not consent, and fault grounds. It explains why Pennsylvania has no formal legal separation, how marital property is divided under equitable distribution, temporary support while a case is pending, and the statutory factors courts weigh before awarding alimony.
For parents, the guide explains the best-interest custody factors in 23 Pa.C.S. § 5328, including the 2024 and 2025 amendments, the difference between legal and physical custody, parenting plans, relocation, modification, and contempt. It also explains how the statewide child support guidelines and the Domestic Relations Section conference work.

QUESTIONS BEFORE YOU BUY
Pennsylvania divorce and child custody: what to know before you order.
Straight answers about what the guide is, what it covers and how it reaches you.
How long does a mutual consent divorce take in Pennsylvania?
A mutual consent divorce under 23 Pa.C.S. § 3301(c) has a 90-day waiting period after the complaint is filed and served before the spouses can sign affidavits of consent. When all economic and custody issues are resolved, the case can conclude shortly after that. Contested cases often take a year or more.
How is child support calculated in Pennsylvania?
Pennsylvania uses statewide child support guidelines based mainly on the parents' net monthly incomes and the number of children, with adjustments for health insurance, child care, and substantial shared custody. A conference officer at the county Domestic Relations Section applies the guidelines first.
Is this legal advice?
