Pennsylvania probate, explained for executors and heirs
The Register of Wills, grant of letters, the inventory, creditor claims, inheritance tax, small estates, and the elective share, explained from both sides of an estate.
ABOUT THIS BOOK
Someone has died in Pennsylvania, and the estate now needs attention. Register of Wills or Orphans' Court? Letters testamentary? REV-1500?
The Pennsylvania Probate Law Guide explains how estates are administered under the Probate, Estates and Fiduciaries Code (Title 20). It covers the two-part system in which the county Register of Wills handles the opening steps and the Orphans' Court Division hears disputes, the Petition for Grant of Letters, and the difference between an executor and an administrator. It explains which assets pass through probate and which pass outside it, the Notice of Estate Administration, advertising the grant of letters, the inventory, creditor claims and their priority, the family exemption, and the status report due when administration runs past two years.
The guide also explains Pennsylvania's inheritance tax, from 0 percent for a surviving spouse to 15 percent for most other heirs, with the return due nine months after death, plus the small estate petition for personal property of $50,000 or less, the surviving spouse's one-third elective share, intestate succession, and will contests.

QUESTIONS BEFORE YOU BUY

Straight answers about what the guide is, what it covers and how it reaches you.
What is the small estate limit in Pennsylvania?
Pennsylvania's settlement of small estate on petition is available when the decedent's personal property has a gross value of $50,000 or less, not counting real estate and certain other payments (20 Pa.C.S. § 3102). The Orphans' Court Division can order distribution without a full grant of letters.
When is the Pennsylvania inheritance tax return due?
The inheritance tax return, Form REV-1500, is due nine months after the date of death. Rates run from 0 percent for a surviving spouse to 4.5 percent for direct descendants, 12 percent for siblings, and 15 percent for most others. A 5 percent discount applies to tax paid within three months.
