How Oklahoma wills, trusts, and estate plans work
Will requirements, handwritten wills, living trusts, transfer on death deeds, spousal rights, and incapacity documents under Oklahoma law.
ABOUT THIS BOOK
An Oklahoma estate plan has to meet specific legal rules to work as intended, and the state's rules differ in several ways from other states.
The Oklahoma Wills, Trusts & Estates Guide explains how estate planning works in Oklahoma. It covers the requirements for a formal will, including two witnesses, how a self-proving affidavit works, and why Oklahoma accepts a holographic will that is entirely handwritten, dated, and signed. It explains revocable and irrevocable trusts under the Oklahoma Trust Act, spendthrift provisions, certifications of trust, and the nontestamentary transfer on death deed for real estate.
The guide also explains a surviving spouse's right to at least one-half of property acquired by the couple's joint industry, who inherits when there is no will, how wills are changed or revoked, and incapacity documents such as the advance directive for health care and the durable power of attorney. For those carrying out a plan, it covers executor and trustee duties, disclaimers filed within nine months, and court confirmation of trusts.
• Step-by-step procedures for the person making a plan and for executors, trustees, and beneficiaries
• Real-world questions and answers on wills, trusts, and inheritance
• Checklists, comparison tables, a glossary, and sample clause outlines
This guide is for Oklahoma residents planning ahead and for the people who administer or inherit from an estate. Legal information, not legal advice.

QUESTIONS BEFORE YOU BUY
Oklahoma will requirements: what to know before you order.
Straight answers about what the guide is, what it covers and how it reaches you.
Can a handwritten will be valid in Oklahoma?
Yes. Oklahoma recognizes a holographic will that is entirely written, dated, and signed in the testator's own handwriting, and it does not require witnesses (Okla. Stat. tit. 84, § 54). The guide compares it with a formal will.
Can a spouse be disinherited in Oklahoma?
Not completely. Oklahoma law protects a surviving spouse's right to at least one-half of property acquired by the couple's joint industry during the marriage, regardless of the will (Okla. Stat. tit. 84, § 44). The guide explains the election.
Is this legal advice?
No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.
Is it written for Oklahoma?
Yes. This guide is written for Oklahoma law and cites the Oklahoma statutes and rules it relies on. If your case is in another state, choose that state's edition.
