How Oklahoma probate works, from petition to final decree

Letters, inventory, creditor notice, summary administration for estates of $200,000 or less, and the $50,000 small estate affidavit.

ABOUT THIS BOOK

When someone dies in Oklahoma, the people left behind often need to understand probate quickly. Oklahoma has not adopted the Uniform Probate Code, so its process follows its own statutes in Title 58.

The Oklahoma Probate Law Guide explains how probate works in the District Court of the county where the decedent lived. It covers the roles of executors and administrators, how letters testamentary and letters of administration are issued, the oath and bond, the inventory and appraisement, and the published notice to creditors that opens a window of at least two months for claims.

The guide explains the simplified options as well: summary administration for estates valued at $200,000 or less, and the small estate affidavit for personal property when the decedent's Oklahoma probate property, less liens, does not exceed $50,000. It also covers will contests, the rights of heirs and beneficiaries, removal of a personal representative, the final account, and the final decree.

• Step-by-step procedures for the executor or administrator and for heirs and beneficiaries
• Real-world questions and answers on timelines, creditors, and inheritances
• Checklists, comparison tables, a glossary, and sample document outlines

This guide is for families and personal representatives settling an Oklahoma estate. Legal information, not legal advice.

QUESTIONS BEFORE YOU BUY

Oklahoma probate process: what to know before you order.

Straight answers about what the guide is, what it covers and how it reaches you.

What is the small estate limit in Oklahoma?

A small estate affidavit may be used to collect personal property when the decedent's Oklahoma probate property, less liens and encumbrances, does not exceed $50,000 (Okla. Stat. tit. 58, § 393). It cannot transfer real estate. The guide explains the process.

What is summary administration in Oklahoma?

Summary administration is a faster court process available for estates valued at $200,000 or less, and in certain other situations (Okla. Stat. tit. 58, § 245). The guide explains who qualifies and how it compares with full probate.

Is this legal advice?

No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.

Is it written for Oklahoma?

Yes. This guide is written for Oklahoma law and cites the Oklahoma statutes and rules it relies on. If your case is in another state, choose that state's edition.
