Hawaii renting rules, explained for tenants and landlords
Security deposits, habitability, entry, the ten-day rent notice, mandatory mediation, and summary possession under HRS Chapter 521.
ABOUT THIS BOOK
Renting in Hawaii is governed by detailed state rules that cannot be waived in a lease. Tenants and landlords who know those rules are better placed to avoid disputes and costly mistakes.
The Hawaii Landlord-Tenant Guide explains the Residential Landlord-Tenant Code, Chapter 521 of the Hawaii Revised Statutes. It covers what the law requires at move-in, during the tenancy, and at move-out, and how an eviction case proceeds through a summary possession action in District Court.
Topics include:
• The one-month cap on security deposits and pet deposits (HRS § 521-44)
• The 14-day deadline for returning a deposit or itemizing deductions
• The statutory warranty of habitability under HRS § 521-42
• Two days' notice for non-emergency landlord entry
• The ten-calendar-day notice for nonpayment and mandatory mediation under Act 278 (2025)
• The 45-day and 28-day notices for ending a month-to-month tenancy
• Summary possession, judgment, and the writ of possession
The guide follows each step from two viewpoints, the tenant and the landlord. The Toolkit adds checklists, comparison tables, a glossary, sample notices, and questions to ask an attorney.
This guide is for Hawaii renters and property owners who want a clear view of the rules on both sides of the lease. Legal information, not legal advice.

QUESTIONS BEFORE YOU BUY
Hawaii landlord tenant law: what to know before you order.
Straight answers about what the guide is, what it covers and how it reaches you.
How much can a landlord charge for a security deposit in Hawaii?
The security deposit is capped at one month's rent. A separate pet deposit is allowed, but it is also capped at one month's rent (HRS § 521-44(b)). The guide explains the 14-day return rule.
Is mediation required before an eviction for unpaid rent in Hawaii?
For nonpayment, the landlord sends the ten-day notice to a mediation center. If mediation is scheduled in time, the landlord must take part and generally waits 20 calendar days to file (HRS § 521-68).
Is this legal advice?
