How Hawaii injury claims work, from deadline to resolution

The two-year filing deadline, the 51 percent bar, the no-fault car threshold, claims against government, and CAAP arbitration.

ABOUT THIS BOOK

After an injury in Hawaii, two rules shape almost every claim: how long a person has to file, and how fault is shared. Understanding them early makes the rest of the process easier to follow.

The Hawaii Personal Injury Guide explains Hawaii negligence law, from the four elements of a negligence claim to how damages are calculated and reduced. It covers the two-year statute of limitations under HRS § 657-7, the discovery rule, and what happens when the deadline is missed.

Topics include:
• Modified comparative negligence and the 51 percent bar under HRS § 663-31
• Hawaii's no-fault car insurance, PIP benefits, and the $5,000 tort threshold
• Claims against the State under the State Tort Liability Act, and county notice rules
• Wrongful death and survival actions
• Joint tortfeasors and how fault is apportioned
• The Court Annexed Arbitration Program (CAAP) for Circuit Court cases

The guide follows a claim from two viewpoints, the injured person and the defendant or insurer, from the first steps after an injury through discovery, arbitration, settlement, and trial. The Toolkit adds checklists, comparison tables, a glossary, and questions to ask an attorney.

This guide is for anyone who wants to understand how injury claims work in Hawaii. Legal information, not legal advice.

QUESTIONS BEFORE YOU BUY

Hawaii personal injury statute of limitations: what to know before you order.

Straight answers about what the guide is, what it covers and how it reaches you.

How long is the statute of limitations for personal injury in Hawaii?

The general deadline is two years from when the claim accrued (HRS § 657-7). A discovery rule can delay the start until the injury and its cause are, or reasonably should be, discovered.

Can someone partly at fault still recover damages in Hawaii?

Yes, if their fault is not greater than the defendants' combined fault. The award is reduced by their share of fault, and a person found 51 percent or more at fault recovers nothing (HRS § 663-31).

Is this legal advice?

No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.

Is it written for Hawaii?

Yes. This guide is written for Hawaii law and cites the Hawaii statutes and rules it relies on. If your case is in another state, choose that state's edition.
