How Virginia probate works, from qualification to closing

The Circuit Court Clerk, the Commissioner of Accounts, notice of probate, inventories and accountings, the probate tax, and small estates, explained in plain language.

ABOUT THIS BOOK

Someone you love has died in Virginia, and the estate has to be settled. Virginia has not adopted the Uniform Probate Code, and its process has features that surprise people who have seen probate elsewhere.

The Virginia Probate Law Guide explains estate administration under Title 64.2 of the Code of Virginia. It covers qualification of an executor or administrator before the Circuit Court Clerk, letters testamentary and letters of administration, and the oversight of the Commissioner of Accounts.

The guide covers:
• Notice of probate (Forms CC-1616 and CC-1617) and its 30-day deadline
• The inventory (Form CC-1670) and accountings (Form CC-1680)
• The probate tax of 10 cents per $100, with estates of $15,000 or less exempt
• The small estate affidavit for personal probate estates of $75,000 or less
• The statement in lieu of settlement (Form CC-1681) and closing the estate

Each topic is explained from two perspectives: the executor or administrator and the heir or beneficiary. Real-world questions and answers on creditors, timelines, bonds, the elective share, and intestacy, plus checklists and a glossary, round out the guide.

This guide is for families and personal representatives settling an estate and for heirs who want to understand their rights. Legal information, not legal advice.
