Vermont probate, explained step by step

How an estate is opened, when the small estate proceeding or waiver of administration applies, how creditor claims are handled, and how the estate is closed.

ABOUT THIS BOOK

When someone dies, the people left behind often face a court process they have never seen, with forms, deadlines, and duties to heirs and creditors.

The Vermont Probate Law Guide explains estate administration under Title 14 of the Vermont Statutes in the Superior Court Probate Division. It covers why Vermont, a non-UPC state, has no informal probate, why unwitnessed handwritten wills are not valid (14 V.S.A. § 5), the small estate proceeding for estates of $45,000 or less consisting entirely of personal property (14 V.S.A. § 1901), and waiver of administration for a sole beneficiary who also serves as fiduciary (14 V.S.A. § 1852).

The guide walks through an estate from two points of view, the executor or administrator and the heir or beneficiary. It explains the petition to open an estate, letters testamentary and letters of administration, the four-month creditor claim period, the 60-day inventory, probate fees, estate tax clearance, the final accounting and decree of distribution, will contests, intestate succession, abatement, and disclaimers.

A toolkit adds checklists, comparison tables, a glossary, common mistakes, questions to ask an attorney, and sample structures.

Straight answers about what the guide is, what it covers and how it reaches you.

What is the small estate limit in Vermont?

An estate with a fair market value of $45,000 or less that consists entirely of personal property (a time-share is allowed) may use the small estate proceeding (14 V.S.A. § 1901). The guide explains the process.

How long do creditors have to file claims in Vermont probate?

Generally four months after the first publication of the notice to creditors (14 V.S.A. § 1203). The guide explains notice, review of claims, and payment.
