Oregon criminal cases explained, from arrest to sentencing

How crimes are classified, how pretrial release works without bail bonds, what happens at arraignment, and how Measure 11 and the sentencing grid shape a sentence.

ABOUT THIS BOOK

An arrest moves fast, and the terms that follow it, such as arraignment, security release, and Measure 11, can be hard to follow. Families often feel just as lost as the person charged.

The Oregon Criminal Law Guide explains how criminal cases work under the Oregon Revised Statutes. It covers the four culpable mental states in ORS 161.085, how felonies and misdemeanors are divided into Class A, B, and C, and the statutory maximum terms and fines for each class. It explains why Oregon has no commercial bail bond industry and how a security deposit, typically 10 percent of the amount set, works under ORS 135.265.

The guide walks through each stage of a case from two points of view, the accused person and the family member or supporter: arrest and booking, arraignment, release conditions, the preliminary hearing or grand jury, pretrial motions, plea negotiations or trial, and sentencing. It explains Measure 11 mandatory minimums under ORS 137.700, the Criminal Justice Commission sentencing guidelines grid, diversion and conditional discharge, the unanimous jury requirement after Ramos v. Louisiana, and petitions for post-conviction relief under ORS 138.510.

A toolkit adds checklists, comparison tables, a glossary, common mistakes, and questions to ask an attorney.

QUESTIONS BEFORE YOU BUY

Oregon criminal charges: what to know before you order.

Straight answers about what the guide is, what it covers and how it reaches you.

Does Oregon use commercial bail bonds?

No. Oregon abolished commercial bail bonds. When a judge sets a security release, a deposit is typically 10 percent of the amount set and is paid to the court (ORS 135.265). The guide explains each type of release.

What are the maximum penalties for a felony in Oregon?

Statutory maximums are 20 years and $375,000 for a Class A felony, 10 years and $250,000 for Class B, and 5 years and $125,000 for Class C (ORS 161.605, 161.625). The guide explains how Measure 11 and the sentencing grid affect actual sentences.

Is this legal advice?

No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.

Is it written for Oregon?

Yes. This guide is written for Oregon law and cites the Oregon statutes and rules it relies on. If your case is in another state, choose that state's edition.
