Understand how an Ohio estate is settled, step by step
Opening an estate, letters of authority, small estate options, creditor claims, will contests, and closing with the final account.
ABOUT THIS BOOK
When someone dies in Ohio, their estate may need to pass through the probate court. Ohio follows its own probate statutes rather than the Uniform Probate Code, and each of its 88 counties can add local rules and forms.
The Ohio Probate Law Guide explains estate administration under Title 21 of the Ohio Revised Code, in the Court of Common Pleas, Probate Division. It covers how to open an estate, the difference between an executor and an administrator, letters of authority, and when a fiduciary bond is required.
The guide explains Ohio's simplified options for smaller estates. Release from administration is available for estates of $35,000 or less, or up to $100,000 when everything passes to a surviving spouse. Summary release is available for the smallest estates. It also explains which assets pass outside probate, including transfer-on-death real estate.
• The inventory, due within three months of appointment
• Creditor claims and the six-month presentation period
• Surviving spouse rights and the allowance for support
• Will contests and the three-month deadline
Each chapter speaks to both the executor or administrator and the heir or beneficiary, with real-world questions and answers, checklists, a glossary and comparison tables. Legal information, not legal advice.
