New Jersey probate, explained from the Surrogate to closing

Letters Testamentary, small estate affidavits, the inheritance tax, creditor claims, caveats, and the release and refunding bond.

ABOUT THIS BOOK

When someone dies, the people left behind are often handed responsibilities they never expected. New Jersey probate has its own structure, and much of it runs through a county official most people have never heard of: the Surrogate.

The New Jersey Probate Law Guide explains estate administration under Title 3B of the New Jersey Statutes. It covers the two-track system, in which the County Surrogate handles uncontested matters and the Superior Court, Chancery Division, Probate Part hears disputes. It explains the 10-day waiting period before probate, how Letters Testamentary and Letters of Administration are issued, and which assets pass outside probate.

The guide also walks through:
• Small estate affidavits for intestate estates up to $50,000 for a surviving spouse or domestic partner, or $20,000 for other heirs
• The inheritance tax, with Class A beneficiaries fully exempt, and the repeal of the estate tax for deaths on or after January 1, 2018
• The nine-month creditor claim period
• Caveats, will contests, and the four- or six-month deadline to challenge a probated will
• Informal and formal accountings and the release and refunding bond

Separate sections speak to the executor or administrator and to the heir or beneficiary, with checklists, comparison tables, a glossary, and questions to ask an attorney. Legal information, not legal advice.
