Four paths through Nevada probate, explained step by step
The small estate affidavit, set-aside, summary and general administration, letters, creditor claims, the inventory and closing a Nevada estate.
ABOUT THIS BOOK
When someone dies in Nevada, the size of the estate largely decides how it is settled. The Nevada Probate Law Guide explains each path, for the personal representative running the estate and for the heirs and beneficiaries waiting on it.
The guide explains Nevada's four paths: the affidavit of entitlement for estates of $25,000 or less with no Nevada real property ($150,000 for a surviving spouse) under NRS § 146.080; the set-aside without administration for estates of $150,000 or less under NRS § 146.070; summary administration for estates of $500,000 or less under NRS § 145.040; and general administration above that.
It covers lodging the will within 30 days, Letters Testamentary and Letters of Administration, probate commissioners in Clark and Washoe Counties, notice to creditors and the 90-day and 60-day claim periods, the order of payment under NRS § 147.195, the statutory fee for a personal representative, the final accounting, and will contests. It also explains community property, intestate succession, and Nevada's lack of a state estate or inheritance tax.

How long does probate take in Nevada?
It varies. The guide notes a simple summary administration may take six to nine months and general administration a year or more, with creditor periods of 60 or 90 days.
