Settling a Louisiana succession, explained one step at a time
Small succession affidavits, independent administration, the descriptive list, forced heirship, and the judgment of possession.
ABOUT THIS BOOK
Someone you love has died in Louisiana, and the process ahead is called a succession, not probate.
The Louisiana Probate Law Guide explains how a succession works under the Louisiana Civil Code and Code of Civil Procedure. It explains seizin, testate and intestate successions, heirs and legatees, and how community property and separate property shape what belongs to the estate. It explains how a succession is opened in the parish district court and how executors and administrators receive their letters.
It walks through the paths for settling a succession: the small succession affidavit for a Louisiana domiciliary whose property has a gross value of $200,000 or less (La. C.C.P. art. 3421), simple possession without administration, administered successions with a tableau of distribution, and independent administration. It explains the sworn detailed descriptive list, forced heirship and the legitime, the surviving spouse's usufruct, and why Louisiana has no state estate or inheritance tax.
• Step-by-step duties for executors and administrators
• A separate path for heirs and legatees
• Creditor claims, final accounts, and the judgment of possession
• Checklists, comparison tables, a glossary, and sample outlines
For families settling a Louisiana succession. Legal information, not legal advice.
