Kansas rental rules for tenants and landlords, in plain language

Security deposit limits, repairs and habitability, entry notice, eviction notices, and the forcible detainer process under Kansas law.

ABOUT THIS BOOK

A deposit has not come back, a repair has been ignored, or rent has gone unpaid. Kansas has specific rules for each of these situations.

The Kansas Landlord-Tenant Guide explains the Kansas Residential Landlord and Tenant Act, found in Chapter 58, Article 25 of the Kansas Statutes Annotated. It covers who the Act applies to, the implied warranty of habitability, and why its protections cannot be waived in a lease.

The guide explains the security deposit limits: one month's rent for an unfurnished unit, one and one-half months' for a furnished unit, plus up to one-half month's rent as a pet deposit. It explains the 30-day return rule and the damages of one and one-half times the amount wrongfully withheld (K.S.A. 58-2550). It also explains the "reasonable notice" standard for entry, the written notice and 14-day repair process (K.S.A. 58-2559), and why Kansas has no general repair-and-deduct remedy.

• The 3-day notice to pay rent and the 14/30-day notice to cure
• Forcible detainer cases and writs of restitution under Chapter 61
• Abandoned property and eviction record expungement
• Comparison tables, a glossary, and model notices

For tenants and landlords on either side of a Kansas rental. Legal information, not legal advice.

QUESTIONS BEFORE YOU BUY

Kansas landlord tenant law: what to know before you order.

Straight answers about what the guide is, what it covers and how it reaches you.

How long does a Kansas landlord have to return a security deposit?

Generally 30 days after the tenancy ends, possession is returned, and the tenant demands the deposit (K.S.A. 58-2550(b)). The guide explains itemized deductions and the penalty for wrongful withholding.

Can a Kansas tenant withhold rent until repairs are made?

No. Kansas law does not allow simple rent withholding. The guide explains the written notice process under K.S.A. 58-2559, the 14-day period for the landlord to begin repairs, and lease termination.

Is this legal advice?

No. It is legal information in plain language, cited to the law, so you understand your options and know what to ask. Reading it creates no attorney-client relationship.

Is it written for Kansas?

Yes. This guide is written for Kansas law and cites the Kansas statutes and rules it relies on. If your case is in another state, choose that state's edition.
