Understand an Idaho injury claim, from fault rules to deadlines

The two-year deadline, the 50 percent fault bar, the noneconomic damages cap, and the 180-day notice for claims against government entities.

ABOUT THIS BOOK

An accident has left someone hurt, and the questions start right away: who pays, how fault is counted, and how long there is to act. Idaho answers those questions with rules that differ from many states.

The Idaho Personal Injury Guide explains how injury claims work under Idaho negligence law, from the first insurance call to a lawsuit in the Magistrate Division or District Court. It covers the two-year statute of limitations in Idaho Code § 5-219(4) and the modified comparative negligence rule in § 6-801, under which a person 50% or more at fault recovers nothing.

The guide also explains:
• The noneconomic damages cap under § 6-1603, set at $538,425.04 for July 1, 2026 through June 30, 2027, and its exceptions
• Idaho's limits on joint and several liability
• The 180-day notice of tort claim for claims against government entities
• Worker's compensation, dram shop, and wrongful death claims
• Discovery, settlement, and trial

Separate chapters speak to the injured person and to the defendant or insurer. Checklists, comparison tables, a glossary, and questions for an attorney complete the guide.

For anyone on either side of an Idaho injury claim. Legal information, not legal advice.
